A Tree Replacement Notice has been served on Allanwater Developments Limited.

The council considered it expedient to serve the Tree Replacement Notice as the removal of the trees at Holmehill has a detrimental impact on the landscape setting and the character of the Conservation Area. The notice requires the replanting in accordance with good forestry practice of 20 trees of the following specification:

  • 5 No Oak (Container grown 10L, height 2/2.5m)
  • 5 No Lime (Container grown 10L, height 2/2.5m)
  • 5 No Sweet Chestnut (Container grown 45L, 6/8 light standard, height 2.5/3m)
  • 5 No Hazel (Container grown 3L, height 45/60cm)

The notice takes effect on the 23rd July 2014 and has a compliance period of 1 month. An appeal may be lodged against the notice prior to the effective date i.e 23rd July 2014. An appeal would suspend the effect of the notice until such times as a reporter from the Directorate for Planning and Environmental Appeals has assessed the case and given a ruling.

Failure to comply with a Tree replacement Notice that has taken effect can result in remedial action by the council to plant the trees and recover the costs from the landowner.
